These Terms and Conditions (“T&Cs”) apply to all trade promotions, purchases, memberships, and services offered by North Borders Pty Ltd (ABN 16 673 402 205) (“Promoter”, “we”, “our”, “us”) via https://northborders.co.

By purchasing eligible products, entering promotions, or using our website, you agree to be bound by these T&Cs as amended from time to time. Updates will be published on our website and apply from the date of publication.

1. Eligibility to Enter

• Entry into trade promotions is automatic upon purchase of eligible products listed on our website.
  

• Entrants under 18 years of age may enter with verifiable parental/guardian consent.
  

• Trade promotions are open to residents of Australia and international entrants where local laws permit. International entrants are responsible for confirming legal eligibility.
  
  

2. How to Enter

• Eligible entries are automatically generated upon purchase of specified products.
  

• The promoter reserves the right to disqualify any entrant suspected of tampering, multiple account use, bot entries, fraud, misrepresentation, or breach of these T&Cs.

3. Purchases, Refunds & Consumer Guarantees

• Goods or digital products purchased in conjunction with trade promotions are non-refundable for “change of mind” or for the sole reason of not winning.
  

• Failure to win does not constitute failure by the promoter to supply goods/services under Australian Consumer Law.
  

• Entrants agree not to initiate chargebacks, reversals, or compensation claims via PayPal, Stripe, or other payment providers on this basis.
  

• Refunds are only available where required under the Australian Consumer Law (ACL) for goods/services not of acceptable quality, not fit for purpose, or not as described.
  

• Manufacturer warranties apply to physical products supplied. No additional warranties are provided.
  

• When refunds are processed, they will be sent to the original payment method.
  
  

4. Prize Details & Value

The total prize pool is valued at AUD $22,429, comprising:

🥇 1st Prize Creator Bundle (Major Prize) – Approx. Value: $12,346
🥈 2nd Prize Creator Bundle – Approx. Value: $5,737
🥉 3rd Prize Creator Bundle – Approx. Value: $4,346

All prize values are approximate and subject to availability or pricing changes at time of fulfilment.

If any prize becomes unavailable, this will be managed in accordance with Section 5 below.

Prizes are supplied new unless otherwise stated, and standard manufacturer warranties apply where offered. No additional warranties are provided by the promoter. Where substitution is required, this will be managed in accordance with Section 5 below.

5. Substitution of Prizes

If a prize becomes unavailable, the promoter reserves the right to substitute with an item of equal or greater value, subject to regulatory approval.

Prizes are not transferable, exchangeable, or redeemable for cash unless authorised by the promoter.

6. Promotion Period & Draw Details

Start Date: Monday, 1st September 2025, at 9:00pm AEST
Closing Date: Tuesday, 1st October 2025, at 6:00pm AEST

Draw Date & Time: Tuesday, 1st October 2025, at 9:00pm AEST

The draw will also be conducted in Glen Iris, VIC 3146.

The draw will be conducted fairly and transparently, with all eligible entries receiving equal chance. All winners will be randomly selected in the following order: 3rd Prize, 2nd Prize, and Major 1st Prize drawn last.

7. Winner Notification & Publication

Winners will be announced on 1st October 2025 via the @northborders Instagram and contacted directly via the phone number and/or email address provided during purchase.

Where prize value exceeds $250, the winner’s first name initial and country will be published on northborders.co within 30 days, as required by Schedule 11, section 4 of the Lotteries Regulations 2021 (SA).

By accepting a prize, winners consent to their name, likeness, and general location (state/country) being used by the promoter for publicity, marketing, and promotional purposes without further compensation, unless prohibited by law.

8. Unclaimed Prizes & Redraws

If a prize is not claimed within 30 days, the promoter will attempt to contact the winner weekly for 30 days using the contact details provided.

If still unclaimed, a redraw will occur on 10th November 2025 at 6:00pm AEST at the same location (or such later date as permitted by relevant State or Territory regulations, but within 3 months of the original draw).

Winner details (first name initial and country) will be published on northborders.co within 30 days of both the initial and redraw dates.

9. Shipping, Risk & Insurance

• Risk of loss, theft, or damage passes to the winner once prizes are dispatched.
  

• The promoter is not responsible for damage or loss in transit.
  

• Winners are responsible for arranging additional insurance if desired.
  

• International winners are responsible for all import duties, taxes, and compliance with local laws.
  
  

10. Memberships & Subscriptions

• Memberships access to discord, exclusive content, offers, and may include automatic entries into trade promotions.
  

• Subscriptions are billed in advance and renew automatically until cancelled.
  

• Members may cancel via their online account; cancellations take effect at the end of the current billing cycle.
  

• Promotional or giveaway-linked memberships are non-refundable.
  

• Failure to pay subscription fees may result in suspension, termination, and forfeiture of accumulated entries.
  
  

11. Privacy & Data Use

• All data is handled in accordance with the Privacy Act 1988 (Cth).
  

• Entrants consent to their details being used for promotion administration, winner publication, and marketing purposes.
  

• The promoter may contact entrants via email, phone, or SMS. Entrants can opt-out of marketing communications at any time.
  
  

12. Liability & Indemnity

• Entrants indemnify the promoter against any costs, claims, or losses caused by breach of these T&Cs.
  

• To the maximum extent permitted by law, the promoter excludes liability for any indirect, consequential, or special loss or damage, including lost opportunity or profits.
  

• Aggregate liability will not exceed the greater of AUD $10 or the amount paid by the entrant in the past 12 months.
  

• Nothing in these T&Cs limits rights under the Australian Consumer Law.
  
  

13. Force Majeure & Cancellation

• If unforeseen circumstances (e.g. natural disasters, fraud, system failure) affect the promotion, the promoter may modify, suspend, or cancel it in accordance with applicable laws.
  

• The promoter may also cancel or vary promotions at its discretion where reasonably necessary.
  
  

14. Intellectual Property

• All intellectual property on our website and promotions, including logos, images, and content, remains our property.
  

• Entrants must not use, reproduce, or distribute our materials without prior consent.
  
  

15. Jurisdiction & Governing Law

• These T&Cs are governed by the laws of Victoria, Australia.
  

• International entrants agree to submit to the exclusive jurisdiction of the courts of Victoria.
  
  

16. Severability

If any provision of these T&Cs is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
